Sony Gets Federal Court to Temporarily Block Sale Of PS3 Modchips

Yesterday, Sony Computer Entertainment Australia was granted a temporary injunction by the nation's Federal Court to block the importation and sale of the new PS3 modchips.

The injunction means that until August 31, none of the modchip's Australian distributors will be able to import, sell or otherwise offload the devices. What's more, they have to take all the stock they already have and leave them with Sony's solicitors until the August 31 deadline passes.

Sony has from now until August 31 to convince the courts that the injunction becomes a more permanent arrangement (temporary injunctions are designed to maintain the "status quo" until a matter can be settled). If they succeed, it'll mean the end of legal sales of the device in Australia, but if they fail, then once September 1 rolls around the chips will be able to go on sale.

This is an interesting development, since a 2005 Supreme Court ruling determined that the sale of modchips was legal in Australia (though Nintendo was recently successful in banning the R4). We've contacted Sony to see how they managed to get around this, and will update if we hear back.

Let's hope they get what they want, and maybe then, Sony can get them banned all over the world too, lol.

I wonder if there's a way this could've been solved with a firmware update, aside from disabling USB support.

That's very unlikely, but I'd laugh my ass off if they did it.

Quem disse que a boca é tua?

Qual é, Dadinho...?

Dadinho é o caralho! Meu nome agora é Zé Pequeno!

Where did this pop up from all of a sudden? This is very disturbing and saddening!

I heard it doesn't support playing pirated games off of blu-ray discs but basically people can just download PS3 games on their harddrive and play them through this USB device, or how does it work?

They wouldn't disable it because that's how you charge your controller and other things like a cell phone.

I bet some diehard fans are still calling it fake.. xD

what Sony should do next:

Create subsidiary third party company to make modchips.

re-release the modchip to only work with a firmware of your design. Charge 150$ for the device.

Update the firware to interrupt the USB for a split second every 15 seconds (or something like that) to cancel out the existing USB hack.

Update firmware to require Sony brand ps3 hard drives by some method, say, an extra wire in the cable and HDD. I'm not sure about the logistics of how it would work.

Now your pirates must at least pay you 200$ of net profit, they can't just buy a ps3 and use the USB netting only 10-20$. Deny online to anyone who uses the modchip.

Release a 200$ modchip that allows for hacked games to play online. Update firmware a year later to ban them from PSN.

Upon release of ps4 release a new modchip that does everything for 300$

They are not going to disable USB, lol, Playstation Eye need it.

If they find a stolen code or something, the court will approve banning the Jailbreak. If not, they will start selling it on september 1st. Either way Sony will release a new update bringing some changes for the system, but we costumers won't (very likely) loose any feature.

The genie is out of the bottle good luck trying to put it back in. Especially as the Mod has been pirated itself.
