This depends, if anyone sells the game on a disk then it will be a breach of Nintendo's copyrights and trademarks. This guy will have to obviously offer it free if he wants to avoid prosecution. Also remember the guy in Australia who dumped NewSuperMarioBros origionally, he never charged for the download yet he got sued for damages and royalties.
If someone starts selling this game or Nintendo can prove that it is infringing on Nintendo's rights then yes Nintendo can sue the crap out of him. I think by how easily he is able to create another game Nintendo could just as easily release another NewSuperMarioBros, but I don't expect them to do so anytime soon.
Will I download this?, if I need to modify my Wii then no. I don't know much about the mod scene on the Wii except that in most cases the users are illegally downloading Rom's.

This is the most impressive reason ive seen for homebrew on the wii - I'll definitely give it a shot if its along the same vein as Brawl+ (as in, allow homebrew and run the program, no modding of the wii itself).

I haven't really followed this, but if they use a similar technique to the Fatal Frame 4 translation which just replaces files on the fly, then its unlikely Nintendo will do anything (or even have a legal leg to stand on).

of course there is copyrighted material, all the sprites for one, the engine, the name Wii, the name Mario, super mario, super mario bros, super mario bros wii.
The only thing that will not be copyrighted in his game is the design of the levels.
You guys also think you can take a movie and reedit it then distribute it for free and there is no copyright? this is the same thing, it's illegal.
Now I would applaud this if it were a mario 64 2 or something... but a current gen game, no.
