A streamer who gloated about relentlessly streaming unreleased and emulated Switch games is facing a $7.5 million lawsuit from Nintendo.

Nintendo is coming down hard on Jesse Keighin, aka “EveryGameGuru,” who had allegedly been streaming the pirated games on various platforms such as Twitch, YouTube, and Kick. These included The Legend of Zelda: Tears of the Kingdom, Mario Kart 8 Deluxe, and Pokemon Scarlet and Violet.

According to the lawsuit filed in Colorado District Court on November 6, Keighin, despite prior DMCA takedown notices and cease-and-desist orders, reportedly continued streaming the games and even guided viewers on running Nintendo games on non-Nintendo hardware.

The streamer has been accused of making new channels on different platforms whenever one was taken down. The court documents claim he also taunted the game studio directly while doing so, allegedly stating things like, “You can try to stop me, but I’ll keep going.”

“On October 24, 2024, after certain platforms had taken down his unlawful streams as a result of Nintendo’s enforcement actions, he sent Nintendo a letter boasting that he has ‘a thousand burner channels’ to stream from and [he] ‘can do this all day,'” the lawsuit stated.

The lawsuit claims Keighin’s actions not only violate copyright but also encourage a “culture of infringement” impacting sales and hardware exclusivity.

The game studio has calculated the damages at $150,000 per infraction “on at least fifty occasions in the last two years,” resulting in a total claim of at least $7.5 million. They added: “At least ten different Nintendo games [were streamed] without authorization—all before those titles were released to the public.”

Keighin’s (EveryGameGuru) was streaming Mario & Luigi: Brothership on October 22, ahead of its November 7 release, as a key example.

While the dude literally asked for it, it is genuienly very sad this man's bad behavior will leave him hundreds of thousands under (it's not cheap fighting a lawsuit, esp not from a massive corporation like Nintendo). Nintendo makes some great games, though they lack any sympathy for those who don't use their products in a manner which they deem "ideal". I expect this lawsuit will reach an early settlement, granting mercy to EGG, and hope EGG learns from this.

Nintendo dont have mercy when someone try to use your IP without the permission. Sadly the modders pay for this and when things are related with piracy Nintendo dont have mercy. In my opinion, Nintendo will try to fuck with this guy max as possibly, mainly because he public taunted them like that, so like I said Nintendo will fuck with him with no mercy not just for the money or something like that but to make this a example for the others.

yeah, obv Nintendo's trying to make an example out of him. I don't think they care abt the crumbs they can get out of him Lol. (Plus, if this lawsuit does succeed for Nintendo, then content creators are met with a genuine existential threat to their online presence.) Just feel bad for the person is all idk. I don't think "he gives a bad name to those who emulate games!" is sufficient enough reason to say he deserves to be financially annihilated (and thereby potentially jeopardize his entire future) by some megacorp...not that you said this, though I'd imagine it's not a stretch to assume there are some who hold these beliefs. Utterly vile behavior by Nintendo.

We will need to wait to see what will happen with him in the future, but I'm thinking right now, maybe he have money and did this knowing that will happen early or later.

Piracy laws need to be enforced a lot more strictly, or people are just going to keep doing it.
I hate the idea of these entitled jackasses who illegally undermine the market and those of us who actually pay for the product.
