Even in that case, you still paid for the console, you cannot just pirate a console from thin air. You still bought the thing, and the idea they can just take it away is ludicrous. This applies to whatever software you purchased, you still bought it, so you should have access to it. Nintendo is not going to refund you your games if they ban your account.
