I'm sure I read that Nintendo bought the rights, but it was a fair few years ago. Kyle Hyde has made a minor appearance in a few Smash games, including the latest one.

Hmm, if Nintendo owns the rights, then maybe there is hope for another game. Like F-Zero... some day.
