Sure, as they would with any other patch released for a game they publish.
Though that doesn't mean they acknowledge that there is a problem with their controller, but rather that they allow Arika to do what they think is best for their game. The only thing they checked for in the patch was probably to make sure the patch contains what Arika specified, and if it would cause any problems.

That's not to say that Nintendo don't think there's a problem with their d-pad, but I don't think this patch sheds any light on that.
Let's say Nintendo don't think there's a problem with it. Do you think they would then prohibit Arika from releasing that patch? I don't think so. It's their game, and they're trusted to make those judgement calls.

It's published by Nintendo and used to promote the Nintendo Online service.
Surely Arika just decided to update the D-Pad sensitivity out of the blue, right?
Where did they get the feedback to tweak the controls? Twitter complaints?
Wouldn't said feedback come from the publisher, who is the public face to the userbase?
