If it was for region locking or something else i would agree with you,but for this i'm on Nintendo's side.

Many other companies are now embracing fan games, they realize that fan games grow an IP's fanbase instead of stealing sales from the official games like Nintendo believes. 

Then there's Nintendo's outdated Youtube policy, their outdated Online Network, and as you mentioned, region locking. Nintendo is pretty outdated as a company. 

That being said, I do think it's stupid that these fan game developers waste years of their lives making Nintendo fangames when they know Nintendo's stance on them, it's not like they're going to change their stance just for your game, lol. If they were smart, they wouldn't advertise the game until it was up for download, that way by the time Nintendo's legal team responds it already has millions of downloads. 

Can you name these companies, because when it comes to protecting IPs, I know every company has done it to certain extent. Even Bethesda has. Even Sega has.
