Well we dont know that.. I think it's likely there are dev kits out there, they just arent allowed to talk about it for whatever reason. Likely to hide what they are up to.

I'm sure the big publishers have had the dev kits for a long time now, but still, the WiiU's indie support was excellent, and it would be sad to see Nintendo lose that just because of the dev kits.
