I believe you are thinking of the Killzone lawsuit. Unfortunately that lawsuit was dismissed by the courts, which is why we are seeing Microsoft going this route.

No, that was Sony over Killzone and they ended up settling (iirc) because they know they messed up.  

Sony was the one that started the resolution hyping in the console industry.  This is why the console race are considered peasants. Because they fight over something so silly. 

There was no settlement.

Chen of the U.S. District Court for the Northern District of California, with the agreement of both parties, dismissed the lawsuit "with prejudice" — a legal phrase that means the plaintiff cannot file another legal action on this issue in the future. Terms of the dismissal were filed under seal, and both sides will have to pay their own legal costs."

This is why Microsoft is going to exploit this, they have past presedence on their side.
