The hardware is fully emulated via hardware or software. The source code requires no modification, therforth you don't need permission on a per title basis.

These are basically quick ports, the source code has changed. That is why disc games have to be downloaded (the original code doesn't work) and permission to change/alter the code is required on a case by case bases. It's a great solution, as the Xbox One isn't powerful enough to do true emulation.
