They would need an emulator that makes it easy to upscale the games so devs don't have to invest many resources into it. But I think the Wii U is powerful enough to emulate the 3DS.
The Dolphin emulator obviously on PC upscales Wii/GCN games to 1080p, I'm betting Nintendo could make a far better emulator than that.
I think Nintendo's bigger concern is that they want to avoid a situation where someone buys Animal Crossing for 3DS, then doesn't bother to get the Wii U version because they can already play the 3DS version on their Wii U this way. So that might be a bit of a concern now that Nintendo's home and console lineups have more overlap than ever before.
