A simple way around this, would be to let people use the console Kinect-free. Already been over this. If you could just simply unplug Kinect there would be no problem at all.
You can navigate menus with the controller. You can turn the console on with the controller. You can play games with the controller. You can put Kinect into an "off" state.
There is no reason at all why it has to be plugged in 100% of the time. Let people use it when they want to.
