You seem late to the party. Anyways, they have to abide to German law because they are based in Germany. Sony and Microsoft don't have to abide to the law because they are based in the UK. Nintendo have said that they are trying to work around this, but something tells me this is going to take a while considering how complicated the legal system likes to handle things.

What? How in world would Nintendo have predicted this situation in the 90's? If Nintendo were so "protective" then why is Ninja Gaiden, Zombie U and Bayonetta 2 showing up on the Wii U?
