I understand the OP, but it doesn't seem to be the case just from the feedback you got. It is weird that 18 rated digital titles purchases are time-restricted "due to german law", but german banned titles can be bought...
This doesn't bother me much since I won't be building a digital collection due to Nintendo's online service choices.
