Banning on intent would really only come into play after a user has racked up 500 or more posts. By that time a reputation has been built, so a moderator who kept track of the more active members could judge in 90 % or more cases correctly. Sure, eventually it's bound to hit someone wrongly, but on the bright side it cleans up or prevents a lot of mess.

I know when I see your posts that they are intended to be satirical (and let us not get back into that long-dormant debate about whether or not satire has to be entertaining), but that's because you've been here forever and have posted over 20,000 times. By the time you get to that point, you're clearly NOT a troll (or at least not the bad kind).

To that extent, judging (pardoning) based on intent is fine. Convicting based on intent, on the other hand, is problematic. Generally if somebody has a long list of bans in a short time, they're pretty crappy at stealth trolling anyway.
