It has nothing to do with being conservative. Heck, Nintendo sued Nyko on their nunchuck and that wasn't until that had been on the market for a while. They can't really do anything until after they know if Sony infringed on any patents. Any company that has half a brain running it wouldn't sue until they know if they have a case or not.
