Because Nintendo doesn't care. They are raking in millions and people still buy their software at full price years after the games came out. 3rd parties are free to drop prices whenever they want, so players choice would only really matter for 1st party software. (obviously ignoring the free recognition that 3rd parties would get for making player's choice)
