Now that i ended the practical way, i'm analyzing the moral grounds, so the question is: Is it the right thing to do??? i say yes, but only if it is for the right reasons, if i am bringing down a big fish that really hurts the industry because i care about it, and not just because i'm mad at people getting for free the things that i buy, then it's good, bringing down some puts that sells like 10 copies a month leave him alone, also the cops wouldn't care, now, when that man becomes a medium to big fish then it's right to do it... But again, for the right reasons...

 

It's completely worth it to report him.  Even if he does have some sort of loophole, chances are he's only going to be able to abuse it once.

 

Not necesarilly, if with that loophole he's declared not guilty and wins the case, he can do the same thing again and again and they can't accuse him because that qualifies as double jeopardy... Now to catch that guy again he must be doing something different to build it up as a new case with new evidence...

Now, if he doesn't get away and he's declared guilty or gets a settlement that's different...

 

Exploiting a loophole and then getting caught using that loophole means that hole gets patched.

And Garamond does a good enough job of explaining Double Jeopardy.  Just because I rob a gas station doesn't mean they can't get me the second but I couldn't be prosecuated for killing the same gas attendant twice.

 

You're right, i was not looking at US laws when i brought that up...

But i read your latest posts... It's incredible how a man can compare the act of doing something that might kill him or others by doing it, and selling copied games... Clerk is absolutely right, this flawed composition of morality was brought by extreme capitalism where money is more important than people's lives, and that's what we're seeing right now with the economic crysis...

Sure piracy is piracy and it is stealing and is definitely illegal. Piracy isn't all that bad. Look at it as something to equalize the world. As what was said in a post above, no multimillion company deserves all those wealth for their products no matter how good they are as long as most of the world is starving.

In my country, the average working guy, given that he's part of the 30% of the population that's lucky enough to have a job, earns ~$50 a month. If he spends $1 a day for food, he has a total of $20 for rent, electricity bill, water bill etc.... How about his family? What would they eat? How would you expect someone living in this condition pay for a $60 game? Piracy is rampant here in our country, hell people even photocopy entire books. But honestly, I don't blame them, with the condition our country in, it's the only way we can keep up with the world. Our chauffer's children don't even know what a NES is until I gave him mine last year.

So my take on piracy? Piracy is bad of you have the capability to pay for something but opted to pirate because it is simply free. But for people who need to pirate just to get a taste of the present, I have to say it is justifiable. Don't get me wrong, I'm lucky to be part of the elites here in our country and lucky enough to afford luxuries, but sometimes you have to see the whole picture before making a stand on something.



So I'm just wondering here, who thinks that piracy should be considered a criminal offense?

The world isn't ready to have piracy considered a criminal offense yet.



There are two types of piracy being discussed here.

The first is the person who pirates a game, movie or music online. They were not planning on purchasing the product, so they can justify stealing it and not paying. They see no one losing money with their piracy.

The second is the person who sells pirated merchandise, like the person in the original post. People are paying money for a product. They are making money off of games that other people made.

It is like lending a CD to a friend to rip, vs selling copies of the same CD to 100 people at $3 each. Both are piracy. Both are illegal. The one is ignored, the other one is not.

Should piracy be illegal? Of course it should. Otherwise, I would open an 360/DS mod shop and game sales shop next to every Gamestop in the US. Enforcement should be directed at people making money off piracy. (and who are stupid enough to advertise for it.)
