OH, COME ON!! So what, all the movies stored there that are public domain are also stealing? The games of companies long gone and extinguished, to which there is no other way to get them are also stealing? If I want to get a ROM of a game I already bought, is that also stealing? Or a copy of a song I bought years ago? Bah!

Poland is also a signatory nation.  So that's not much of an issue.  But yes, the FBI would have notified Ukraine to get clearance to take him to the States for trial.  They would be pretty hard pressed to stop such a request, being a signatory nation.  And why would they bother to fight it?  This is the dude's fault and they signed the agreement.  Basically, this is pretty SOP.

What you are basically saying is that if Bob is a drug dealer but also runs a grocery store, he shouldn't be thrown in jail because some of his product is legitimate.  That's not how it works.  The fact is that 90% of the content of that site was not really old, almost inaccesible, or public domain.

Or he'll get what a slap on his wrist like the owner of another site got once.  But if he does get some ridiculous number of years in prison, well that's just mathematics.  They could, in theory, charge him with thousands of counts of Criminal Copyright Infringement.  Even if they are all just 1 year, that would still be life in prison. 

I'm not sure if making a site where people can upload and download files are comparable to raping someone, even if you count thousands of copyright infringements. Raping someone will always be way worse.

I don't think they would need more than a couple dozen people to make an example of to make people think twice.  Charge them together with the site owners as an ongoing criminal enterprise under the RICO Act.  If my memory serves, they could be all charged collectively with the charges.  Just make sure you pick members who are particularly bad (as in, they have consistently and frequently chosen to pirate instead of purchase) and the case would be pretty open shut   And that's easily 2.5 to 10 years in prison along with potentially thousands in fines.  If they wanted to make an example of true criminal copyright infringers and help stem the tide on that front, that's the way they could do it.
