There Will Be Brawl is just as long as the film, and is actually earning money (not to break-even but it doesn't matter) so it's the first to go. They're also going to sell a DVD which I will buy as soon as possible because it's probably illegal for them to sell.

Earning money isn't the point, here. There Will Be Brawl is parody, isn't it? Parodies are protected.

Parodies make money all the time with little or no legal action taken agaisnt them. Don't worry about There Will Be Brawl.



Actually a pretty positive ending. Nintendo themselves handled the situation rather tactfully, rather than releasing the hounds, and the fans acknowledged Nintendo's right to do so, without bitching about how "Nintendo hates its fans" or something like that.

I'm a bit dissappointed that Nintendo decided to take it down, or felt the need to take action at all to be honest. I kinda wish they'd taken some ideas from Valve. When Valve get this sort of thing shown to them they nuture it and even give fans links to the good stuff. They've helped advertise the Black Mesa mod and linked to the fan-made Half-Life movie.

Mods are a different beast altogether though ...

I could be wrong but I suspect that a mod falls more in line with violating a copyright than violating a trademark being that most mods involve modifying an existing product while reusing copyrighted material. There are some significant differences between copyrights, trademarks and patents and (I could be wrong on this) I believe that if you hold a copyright or patent you own it regardless of if you legally defend it or not; whereas a trademark needs to be protected or it is legally indefensible.
