And yeah, I know a LOT of people only flash 360's to play pirate games but there are also a lot of people that do only flash them to play backups of games they actually own, look on xbox-scene for example, they don't allow any talk of piracy and 80% of members there only flash their 360's for LEGAL purposes, hard to believe I know but it does happen!

The 360 *can* damage discs if you move the console while the disc is in the drive.  So unless you turn your 360 on and then just start carrying it around the house in which case you're an idiot (which I don't think you are), I just don't believe you.

Sorry, but you again fit into the bullshit artist pirate.  You can rant and rant how you're an honest pirate and just playing back ups because somehow your 360 and all your friends 360's break discs like crazy but I just won't believe you.

LMAO, when did I say I was an "honest" pirate? I didn't, I have made it clear that I do play many games I have downloaded and I do still also buy a few retail games from stores, I have nothing at all to hide, if i like a game i have downloaded a lot i will go and buy it just like i did with grid, dirt 2, forza 3, cod 4 etc, if not i won't, simple.

And for the record twesterm go take a look on xbox-scene then come back and tell me people don't flash 360's for legal reasons too, hope you like humble pie......

 

And yup, none of my consoles are STILL not banned lol, one of my customers (flashed consoles) has emailed me to let me know they were banned on Friday, only one out of a LOT, and for the record this ban wave is now over, one more to come in November then that's it again until next year, same thing every year, people that do get banned can easily get another 360 and be back up and running on live with a flashed drive within an hour lol, it's ms that loses out during these ban waves, people on certain other sites just laugh at them.

 

Also, a little count a few of the members on a couple of sites have been doing over the weekend:

Counted members with flashed drives + on live - 77,042

Member confirmed banned since 29th October 2009 - 437

*figures above are people that took part in the polls across three sites.

 

Obviously this is only the tip of the ice ber but you can see it really isn't affecting any pirates out there and never will......


Judging by these numbers I think its safe to say that this is big problem and only getting bigger. I am guessing theres atleast 2 million modded 360s out there. I know alot of stores that flash 360s and have their own site. Many people I know don't get banned if they are careful and these sprees just take out the careless modders that usually just sell their banned 360s and get a new one.

These ban waves just bring it to reality that this "problem" is real, the xbox flashing scene is HUGE and I mean HUGE, it's estimated that over 20% of all 360's out in the wild are flashed to play "illegal" games.

These ban waves just bring it to reality that this "problem" is real, the xbox flashing scene is HUGE and I mean HUGE, it's estimated that over 20% of all 360's out in the wild are flashed to play "illegal" games.

 

Very true a friend of mine who was just banned had a new 360 waiting. He just buys a 360 takes the hardware out of the shell puts it in the new shell, brings back the ruined 360. And flashes again with a new 360 with new programs to prevent detection. Its a continual cyle that is so easy to do. Especially to rip off a new 360.



Scary friend chocoloco.  It's one thing to be flash and copy games but it's another to be a thief and commit fraudulent acts.  If your friend is caught he will not just get a fine for copyright infringement but he will get jail time and a criminal record.

Yup, nearly everyone who gets banned on various forums I visit do this exact thing you mention, it is highly illegal but in their words "it is so easy and takes less than 15 minutes to do so why not", this is what I meant earlier when I said its MS that lose out during these ban waves.

And to be clear, I do NOT agree with the above practice and would not do that myself, ever....

I honestly believe this one of the big selling points for the 360. Many ppl I know only bought a 360 due to the fact that it could be moddable. MS can't stop this problem but atleast they are trying. While the 360 modding scene is now where as bad as the PS2 its still causing a lot of lost software sales. This is more evident with software sales in others where the PS3 now is close or outselling multiplats even though the sales diff is 1million.

I'm not sure if you just didn't read the link you posted to or if you're trying to back me up...

 

I suggest you read it again, the parts about tests being performed and producing scratched discs especially.

I read the rest of that and I still say that is not a widespread problem in any way at all, if it were it would come up every time someone made a RRoD joke.  I'm sure there are consoles that scratch discs but it's still hardly a reason to justify "backing up" every game and playing your back ups.

I still absolutely call bullshit on FKNetworks claims.  Unless he's constantly moving around his 360 while playing games, I highly doubt his discs get scratched that often.

Also, we know that MS has been great about admitting their mistakes and taking care of them.  They acknowledged peoples claims, investigated, and didn't find a problem so that's pretty much enough for me.  For other companies I would be a bit more skeptical, but MS has shown that at least this gen they are willing to step up to their mistakes.

Since when does someone need to justify doing something thats legal?  There are plenty of people paranoid about shit like that.

Actual backup copies are the price you pay when you decide your selling whats on the disc... rather then the disc itself.

The US has a fun way around it.

It's legal to own your own backup copy of a computer or console game... but all the devices that could make said copy are illegal because said copies can be uploaded.
