The 360 *can* damage discs if you move the console while the disc is in the drive.  So unless you turn your 360 on and then just start carrying it around the house in which case you're an idiot (which I don't think you are), I just don't believe you.

Sorry, but you again fit into the bullshit artist pirate.  You can rant and rant how you're an honest pirate and just playing back ups because somehow your 360 and all your friends 360's break discs like crazy but I just won't believe you.

I'm not sure if you just didn't read the link you posted to or if you're trying to back me up...

 

I suggest you read it again, the parts about tests being performed and producing scratched discs especially.

I read the rest of that and I still say that is not a widespread problem in any way at all, if it were it would come up every time someone made a RRoD joke.  I'm sure there are consoles that scratch discs but it's still hardly a reason to justify "backing up" every game and playing your back ups.

I still absolutely call bullshit on FKNetworks claims.  Unless he's constantly moving around his 360 while playing games, I highly doubt his discs get scratched that often.

Also, we know that MS has been great about admitting their mistakes and taking care of them.  They acknowledged peoples claims, investigated, and didn't find a problem so that's pretty much enough for me.  For other companies I would be a bit more skeptical, but MS has shown that at least this gen they are willing to step up to their mistakes.

Goodbye to a few friends.  This is exactly why I told them I was not going to mod my 360. Live is the biggest reason I buy games for 360. But, not to worry friends the pirates will soon make new programs to beat this and the pirating will go on.

LMAO, when did I say I was an "honest" pirate? I didn't, I have made it clear that I do play many games I have downloaded and I do still also buy a few retail games from stores, I have nothing at all to hide, if i like a game i have downloaded a lot i will go and buy it just like i did with grid, dirt 2, forza 3, cod 4 etc, if not i won't, simple.

And for the record twesterm go take a look on xbox-scene then come back and tell me people don't flash 360's for legal reasons too, hope you like humble pie......

 

And yup, all of my consoles are STILL not banned, one of my customers (flashed consoles) has emailed me to let me know they were banned on Friday, only one out of a LOT, and for the record this ban wave is now over, one more to come in November then that's it again until next year, same thing every year, people that do get banned can easily get another 360 and be back up and running on live with a flashed drive within an hour lol, it's ms that loses out during these ban waves, people on certain other sites just laugh at them.

 

Also, a little count a few of the members on a couple of sites have been doing over the weekend:

Counted members with flashed drives + on live - 77,042

Member confirmed banned since 29th October 2009 - 437

*figures above are people that took part in the polls across three sites.

 

Obviously this is only the tip of the ice berg but you can see it really isn't affecting hardly any "pirates" out there and never will.....

And I will also say this again, I do not condone piracy, it is wrong end of story BUT if I have the ability to try a full game before buying it to see if I want to go and spend money on it I (and i'm sure many many others) will use that ability, I own 27 FULL retail games I have bought from stores at FULL price, I also own 87 xbox live arcade games, loads and loads of dlc, map packs, song tracks etc, I would put money on it that I spend more on my xbox 360 legally than 70% of people on this site yet I'm still classed as a "pirate" lol.

Go back to my reply twesterm, I said that my retail cod 4 disc no longer works as it is too scratched up from not putting it back in it's case etc, over time it just got worse and now won't work, yes its my fault but hey, one of those things, in this case I downloaded a new version of the game I legally own so I could still play the game I legally own, your allowed to do this, no laws against it at all apart from in ms's xbox live tos which can get you banned for it even though it is not against any laws.

And no, MY 360 does not damage discs but I know plenty of other people that has had problems just like what was shown on BBC watchdog about a year ago, i'm not sticking up for pirates or making excuses as it is clear to me that 95% of all flashed or chipped systems are used illegally, I was just making the point that SOME people do flash their 360's for legal use only as seen CLEARLY over at xbox-scene.

Sorry, but unless you prove FKN is a pirate, it's his words against yours. And if you live in a civilized country, it should apply in such cases the principle "in dubio pro reo", presumption of innocence.

Edit: I read now he admits some downloads, but again, you can't prove every copy is a pirated one and not a fair use backup one.

This said, we can say that against FKN and other people using copies there is the fact that the problem is very uncommon unless XB360 is moved while the disk is spinning. But in their favour there are more facts: fair use allows backup copies, damages can happen whenever you handle discs, and, specifically for XB360, scratches happened without moving the console are rare, but still under investigation and MS has been up until now very greedy and unfriendly towards legit games owners with scratched discs. MS policy about this is to blame users unless forced otherwise by local laws or court rulings, it's clearly written in Kylie's link. Were MS as good about scratched discs as it is about RRoD fixing, the problem wouldn't exist.

Edit: This said, on my PC I use original CD's and DVD's, but my two Sony DVD burners, on the old and new PC, never scratched one, they run silent and smooth, while the old LG CD-R/RW, that kept on spinning CD's at 48X even when vibrations were excessive and it seemed an helicopter, slightly scratched some, but they were still readable.
