This in itself really isn't illegal... but Nintendo has every legal right to "brick" your Wii at the next system update.
Although I believe the Homebrew Channel has been through a number of system updates, so either the channel is staying ahead or Nintendo hasn't taken action against it specifically (though some other mods have been stopped I believe)

Nintendo has tried to stop the HBC, but they've found ways around Nintendo's security measures.

Squilliam: On Vgcharts its a commonly accepted practice to twist the bounds of plausibility in order to support your argument or agenda so I think its pretty cool that this gives me the precedent to say whatever I damn well please.

Well once you own something Im pretty sure youre able to do whatever the fuck you want with it.
Break it, spray paint it,open it, throw it, forget about it. If its YOUR Wii I dont see you doing anything illegal.
It is not criminally illegal to do this. There is a clause to this. End User License Agreement. Nintendo can request that you accept(yes) to an agreement that they presented to you through a download. Then you can be held in breach of contract where legal actions can be taken against you.
I don't believe Nintendo has requested a EULA though. It has offered warnings. So you can do anything to your machine it is neither illegal nor breach of contract. Theres also ownership rights to physical objects. So you do fully physically own your Wii.
