This in itself really isn't illegal... but Nintendo has every legal right to "brick" your Wii at the next system update.

Although I believe the Homebrew Channel has been through a number of system updates, so either the channel is staying ahead or Nintendo hasn't taken action against it specifically (though some other mods have been stopped I believe)
