Also, to make it gaming relevant -- even Nintendo will not pick a fight with the RIAA (the music references and clips are the reason for the lack of Earthbound on the VC). So this lawsuit appears to be Quixotic.

I keep hearing that but actually playing the game and knowing the amazing soundtrack by heart, I really don't see how anyone could link the music in the game to musical artists.
Personally I advocate anything that brings down organizations like the RIAA and gets record labels to change their tone, IE let the artists make their music and give them their fair share of the album profits, not a dollar.
