this isnt their money just because they were accidentally given too much. its not their call whether they return it or not. legal action likely will be taken agaisnt any who dont return it.

It doesn't work this way, from a legal perspective, in the US. A company has the right to require reimbursement within a certain timeframe. The timeframe can vary depending on various state laws.
And yeah, it stinks that a company would ask for the money from someone just let go (unless the sums are way out of line).

Looks like someone at Microsoft has some sense. They decided to let the people keep the overpayments. Pretty nice gesture actually.

Nice gesture on Microsoft's part, but it can be a liability to them. Now the other severed employees who received the correct amount can claim they were "unequally" compensated. This could become a real rats nest for MS.

Ahh yes, America: land of the sue-happy. I see where it could get ugly, but the amounts (approx $5000) mean its probably not worth sueing over. One would hope anyways.
99% of lawyers give the rest a bad name, btw

People are well aware of their severance packages. In fact, you meet with someone from HR to discuss them in detail, neogtiate, etc. If you are ever surprised by your paycheck, say something. It WILL be noticed.
