If you're selling stuff with that image in mind, then yes it is illegal. I thought there would be buyable levels in this game? I don't think Sony will notice if there's anything copyrighted in these ''buyable'' levels. That's the only thing I can think about this whole issue.

It's not only selling stuff.. Using the web for licensed music is also illegal.. even if it's streamed.. well I got the note last week but basically it's: Under the Digital Millennium Copyright Act, webcasters are required to get a statutory license from the Recording Industry Association of America -- on top of fees they pay to ASCAP, BMI, and SESAC, who collect royalties on behalf of songwriters -- in order to stream major-label music on the Net.
Note: in the RIAA eyes a webcaster is someone with a site with music on it... No differences between small, big, non-commercial, commercial... (-edit-I got the dutch version from the RIAA on my back.. but it's the same thing.. pay fees! now!)
And how about all those great MODs for games which where canned because of copyright??*Looks at the canned star wars battlefield mod.. then sees star wars battlefront.. hmmm*
