You are right but only if you distribute in a large scale enough to actually cause a pontentiall loss of sales and as long as you don´t do it in that big scale and keep it to friends/neigbours/family the laws are not applicable to you as it goes under private use.
When you buy a movie here they actually roll the laws that are in effect here before the movie and they clearly state that I can only make a copy for privat use and not for public use and monetary use. i am not allowed to play the movie in a public place or in a public place for monetary use but I am allowed to invite as many people I want to my house for a viewing of the movie or borrowing it to any one I want just as long as I don´t have a monetary gain from it. This is essentially true in the US as well. The laws are worded much more harshly than they can be enforced. Everything in this post is true in the US. Fair Use laws are slightly eroded but still on the books meaning you can still fight anyone attempting to claim damages over an action that is covered by Fair Use. @Greenmedic88 |
I know they allow some linience in your laws as you can borrow a movie to a friend or neighbour but you are not allowed to make your own copies of a movie and games if it doesn´t say so specificly in the user agreement. Thats the biggest differnece between our and your laws and the fact that in theory your laws seem to restrict you more but that can be attributed to the harsh wording as you say.

YES YOU CAN! Fair Use allows you to make a back-up of any media you buy for personal use only. It has been a huge controversy with the various forms of data encryption and is why there has been no large scale crack down on circumventing it. The Fair Use laws are critical to understanding US copyright law and I am certain now you were not informed on them.

I do know about them and I also do know about the persons being prosucuted in cases that should have been protected under that law bet weren´t.
Anyway I responded to the letter you sent me and I think we both agree to just let it go.

Agreed, but we are on the cusp of being exactly on topic I must point out. The essential problem comes from developers attempting to protect themselves with laws that may or may not exist and use misconceptions of the public at large to scare them in-line. I really cannot stand that, and by extention DRM which evolved from the overly aggressive eulas that are found everywhere in the gaming world. I like the Steam method the best despite the bitter taste it leaves in my mouth for personal reasons.

You need to buy 2 copies of Spore if you want to play at the same time as your sister/brother/father/lover/etc. Don't tell me people in the same household shouldn't be able to play a game simultaneously.
That's the problem with that DRM. It's a huge restriction for the average consumer while the average pirate has been playing the games for a week now.
