Before it was announced, they also said Halo 3 wasn't in development, and they were working on another project. We know how that turned out.
And how does Microsoft owning the franchise have anything to do with them working on a game in it? It just means it wouldn't be multiplatform.
^^Because M$ IS working on it without Bungie. That is why Frank O'Conner left Bungie to work at M$ on Halo related games.
