Call Nintendo, tell them your original is scratched and doesn't work anymore and you'd like a replacement. It's like $20. That's what I did, but I never sent my first one back :P

On the nintendo website, on the bottom, they have a "contact" or "contact us" link (most websites do). Go there and use whatever method you choose.
