Which pretty much means developers cannot patch in performance improvements on games they are releasing in the future after NEO releases/or after October or something. Which means if they release the game without using the upgrades on the NEO then it will remain the same if you play it on a NEO.

It doesn't make sense to forbid developers to optimize their games for normal PS4 mode and/or for Neo mode.
So there will be probably a mandatory PS4 mode AND a mandatory Neo mode for future PS4 games, which both can be optimized with additional patches.
The whole "Forward compatibility patches are for old games only" only means that the newer games have to have a Neo mode right from the start and aren't allowed to release without it while older PS4 games have more headroom if and when a Neo mode is handed in later.
Similar regulations happened on other platforms: After the iPhone 5 release, newer iOS apps had to support 16:9-displays, while older apps were allowed to keep the 3:2 aspect.
