Sure it could.But it wouldnt be the same as selling the actual game in a physical form.We need to wait to see if this is true, but when more than 85% of the sales comes in some physical form, I dont think Nintendo is going all digital.They may be unpredictable, but not idiots.

I won'the buy something that is digital only. He only time I buy a digital game is when that is the only way to get it such as spending $5 on a VC game.

it is an easy question, the answer is yes. Stores can sell NX digital codes.
Nintendo already sell 3DS and Wii U code so I don't see why it won't happening
If the NX is the unified handheld/home console concept I believe it will be SD Card based since the games will need to run on the handheld. In other words, the handheld device will have the game card slot and the home console will communicate with the handheld device (ie. it will have no optical drive). I personally believe that this is what the patent is referring to when we saw a console with no Optical Drive.
Stores selling digital download codes would be a poor replacement for selling physical games. You would never get me in the car to drive out to Best Buy to buy a download card: I might be willing to pick up a couple with the initial purchase of the console since I am already at the store but I would never go back for additional games. Retailers would realize this too and a console that only has download cards would have substantially less shelf presence then a console like the PS4 and XOne that offer both physical and digital. Furthermore, this problem would also create a big issue for Nintendo in terms of selling their Amiibo's. Nintendo wants people to come into stores and buy their Amiibo's on one hand, but on the other they would be telling people to stay at home by requiring digital-only purchases. This is a conflicting message and I don't believe that Nintendo would do this.
No I believe that digital downloads will become a bigger trend, but games will still be offered as physical releases on the NX. SD Cards would also allow for backwards compatibility betwween the NX and the 3DS.

No company tries to sell more stuff to the same people over and over again (and often nearly the same suff) than Nintendo- I own all the disk in my home but i do not own all the digital downoads on my console- I merely possess them temporarily at the whim of the console ower (Nintendo in my case) and possibly the software developer/publisher

It had nothing to do with being digital only. (which it wasn't) The revolt was around the console bricking and literally not working when you weren't online. That won't happen with NX. My Nintendo has already set up the infrastructure for a digital only library. Now we just wait.
Digital only is better for the consumer. It's not different from music, movies and PC gaming. That's a fallacy. Possessing digital games temporarily is a fallacy as well.
I've actually seen digital 3DS eShop codes for sale at GameStop. Not joking. Mario Land, you name it.
