I know how people are.
However as for DK MSFT actually did originally think that was a part of Rare. When they went to meet Rare they had seen pictures and cardboard cut outs of Donkey Kong at Rare's office so they had originally thought it was a part of them. However, once the deal was made Im sure they already knew it wasnt, though we dont know that part of the subject.
To this day DKC and DKL has been confusing. It was only just now that NIntendo were finally able to bring them to Eshop (unknown if there was actually a deal with Rare and MSFT to do this). Also enemies disappearing like King K Rool and the crocs can be attributed to the same conversation as all that work was created by Rare and not Nintendo. Because all that DKC has been a confusing subject for over a decade
There isnt too many people who knows more about Rare than I do, or at least on VGC. The part that aggravates me is the bashing of Rare even when they do make good games (Kameo, Conker, Viva Pinatas, etc) yet never even played them.

It shouldn't be. Rare never left Nintendo with the rights to Donkey Kong. This has been stated several times before. Rare themselves also said they were confused when people started bringing up the idea that Microsoft had any rights to DK, saying that it was always a Nintendo IP. You're also mistaken in thinking Nintendo hasn't used those characters since. King K. Rool and the the Kremlings all appeared in various Nintendo games over the last few years, like Mario Super Sluggers, and as a trophy in the latest Super Smash Bros. games. Only reason its still confusing is because people keep spreading the rumor even though the facts are there.
