I doubt we'd see any harsh legal action but Sony might protest to Activision, which might request it be taken down. This really isn't clever at all, as it's perfectly clear what the advertisement is for. The explaination itself voids the idea that it's a loophole. My guess is that Microsoft would take the page down immediately if asked.
However, unless Microsoft starts running real paid spots for "Destiny fragrance", I doubt either Activision or Sony will care.

Pretty sure anyone buying destiny will already have decided which console to buy it for anyway, it's not like this is going to sway someone away from buying it for ps3/ps4.
Only thing funnier than the ad are the threads on various forums this one included full of people upset over the ad and going on about hypocrites and bitter and sore loser.
Sheesh its just a funny ad circumventing a loop hole and advertising a game. There isn't even a "shot" fired at Sony. There is no "mocking" of them. They are entirely irrelevant to the ad. Maybe they will even be busted for it, who knows. But good god, lighten up. Shit is depressing to read.

And they're getting a bunch of gaming sites to spam articles about the "controversy." Pretty manipulative and dishonest presentation.
There are tons of multiplatform games that are advertised as if they are exclusives for Xbox, but people don't tend to recognize that. Plenty of people thought that Titanfall was an Xbox One exclusive, for example. [It's not available on PS, but it's not exclusive.]

I doubt that. Most of Sony's ads are for 1st party games. I haven't seen many PS3-specific ads for 3rd party games aside from Assassin's Creed and Madden. My point? Sony pushes 1st party games in TV ads. Microsoft pushes 3rd party games. The abscence of CoD and *insert 3rd party game here* from Sony's marketing budget doesn't mean M$ paid the publisher off. |
