The difference, guys, for those of you who don't yet understand, is that Sony, when taking "jabs" at MS, didn't violate anyone else's intellectual property when they did so. Nor did they try to work around a PAID agreement with a 3rd party publisher. It's not about "butthurt" or being salty, but about Microsoft complying with existing LAWS designed to protect a publisher's intellectual property. I think they will probably get a "cease and desist" if not a lawsuit from Activision. At the very least, it will probably sour relations between Activision and Microsoft.

The problem is, the "fragrance" is not a real product, and the advertising then directs you to purchase the game.  I don't think an argument that it is an "unrelated product" will hold much weight in a court of law.

I doubt that. Most of Sony's ads are for 1st party games. I haven't seen many PS3-specific ads for 3rd party games aside from Assassin's Creed and Madden. My point? Sony pushes 1st party games in TV ads. Microsoft pushes 3rd party games.

The abscence of CoD and *insert 3rd party game here* from Sony's marketing budget doesn't mean M$ paid the publisher off.

I call BS on this. I have seen PS3 exclusive Madden commercials in the past. CoD? Just because M$ markets the game doesn't mean they have "exclusive"marketing rights. The only thing that MIcrosoft moneyhatted with CoD is DLC. I also don't remember any 360 exclusive GTA IV ads.

I went back and read the article over again but I can't find any mockery at all. Did I miss something somewhere? It's just Microsoft trying to grab a piece of the pie. It's kind of silly and nonsensical but it seems to be entirely harmless. What can they even mock Sony about? "Ha ha, you're going to sell the hell out of Destiny"?

No, the real mockery is by the article, which has manipulated people into a fight over nothing.
