MS has exclusive ad/marketing rights to Call of Duty and Madden, all of last gen and presumably this gen as well. Some of the biggest franchises in all of gaming. And they had exclusive ad/marketing rights to one of the biggest games of last gen, GTAIV.

But as soon as Sony tries the same tactic to promote Destiny, MS goes "wahhhhh, we wanna advertise the game too....but mean old Sony won't let us. Thanks for 'smelling that something was up'" as if Sony did something wrong?

Sure, the "loophole" is funny, but it still screams of butthurt and seperation. And they can probably get in trouble since "Destiny is actually an FPS coming to Xbox" is clearly advertising about a game, not a "fragrance", a game they aren't allowed to advertise

The problem is, the "fragrance" is not a real product, and the advertising then directs you to purchase the game.  I don't think an argument that it is an "unrelated product" will hold much weight in a court of law.
