Me at age 8 when I lived in America:

I didn't, of course, and I didn't learn what the term meant until at least 5 or 6 years later.
Looking back, totally surreal.
I have kids in this age range and I think that based on the kids history(read the OP - he has been in trouble for this before), suspension is the right thing. Little kids respond when it is clear that it is a big deal. I am not saying the suspension should be for weeks or months, but 1 - 2 days would be OK. Based on the mothers response, she isn't going to make sure he understands why this is wrong and he will continue to do this kind of thing.
This is not a big deal if it is handled correctly. The mother failed by bringing it up and talking to the media. She worried about a label on her son in a private file? It is now on the internet for the whole world to read. He is now really labeled for life. What a fool she is...

They wouldnt win. A child under the age of 7 has been found incapable of understanding and commiting a "illegal" act. It would probably be thrown out.
That said, they probably could sue the school for allowing this "heinous" act to occur. Tho it appears that it was not an unwanted act.
Now why do they have to stop the kid for being smooth, it can only help him with ladies later on.
Next up, looking at the opposite sex "the wrong way" will result in suspension.
I read a quote from the mom on CNN earlier about how the boy and girl call themselves BF and GF... Id really be curious to hear what the parents of the girl think.
