Doesn't matter.
You phone could be in your pocket, but as long as its ON the FBI can turn on the microphone and listen in to whatever you are doing.
This isn't about them listening to your phone calls, its about them turning your phone into basically a microphone for them to listen to you 24/7.
so now they can plant bugs without even breaking into your home. every mobile phone is now a potential "bug"

So the fact that they made it earlier and some folks said they did so before (who wre mostly called tin foil heads) makes it okay, I guess?
Luckily, nearly every Android phone can be rooted so you can shut off any remote access for good. But granted, most users won't know how to do that.
