i buy the game new for the new code (allowing me to play without the disc?). however eb games will allow me to return it after ive used the code and give me back full price as long as its within 7 days. this sounds like i now own a free digital copy, but yes a lot of shit needs clearing up by MS

Its not free at all, not even for your friends to play. Your games are locked to your account and your account alone, which is why the system has to be online.

I'm expecting they are offering a bigger cut of the revnue, at the cost of a higher MSRP that the customers have to pay. Much like they offer digital sales in store so you don't have to use the credit card online.

Of course used games work. The system blocks the game until the fee is paid outside of your Xbox live account though.
we dont know how it will efect rentals yet. perhaps rentals will be printed on a disc with a different type of install and set up so that it expires after a certain amount of time. But redbox has a partnership with MS and verizon for on demand video. So I think they are on good terms with MS. Not sure about gamefly. until more specifics are told (how often you have to be online etc) its hard to say. I would hope that MS would not stop rentals.

I'm thinking it has two things it is locked to. Since they said that people who play the game on the same machine can use it. So the games are locked to the MAC code and the account. Because they said that the other people who play on that machine can be done so through the perental controls, or something like that. So they need to know what machine it was in the first place. Or else any machine you sign into can be used to play the game unabated by using the method of install then allow.
How I see it: Game is tied to your account. You can untie it so you can bring it back. Gamestore uses new system to put another code on it and that system will give some money to devs depending how old the game is. In the end used games will rise like 5 euros or so in price. This isn't really so bad

U forget one thing - MS said u can trade ur code only via XBox live.
