How is Android being hurt?

Currently phone manufacturers pay Microsoft  licensing fees for their intellectual property, and because of this, Android will be another BILLION DOLLAR business for Microsoft by next year.  If Microsoft gets the largest Android maker (Samsung) to agree to its 15$ per shipped unit MS will be making multiple billions per year on intellectual patents ALONE.  If Samsung does not agree to MS's price demands they will face potentially even costlier, protracted litigation with no guarantees of victory. 

Why is Android so vulnerable??

Who is ROCKSTAR BIDCO & how did they just cripple Android?

Apple, Microsoft and to lesser degree RIM created Rockstar Bidco as a front group to outbid google for 6,000 Nortel patents at a recent bankruptcy sale.  Google bid 4 billion dollars, but lost to Rockstar Bidco's 4.5 billion dollar offer.  The sale was approved by the courts yesterday

What does this mean for the future of Android? Well Android is VERY VULNERABLE to their competitor's lawsuits because it is entirely open-source.

 

Right now, Android manufacturers are systematically being targeted by Microsoft, Apple and Oracle. Microsoft in particular has been locking up licensing agreements with manufacturers, getting them to pay patent royalties because of alleged Android patent infringement of Microsoft IP. Microsoft has now set its sights on Samsung, the largest of the Android manufacturers, looking to extract $15 a device. Oracle is also approaching manufacturers about licensing deals.
Meanwhile, patent troll Lodsys is going after Android developers with claims that they’re infringing on patents regarding in-app purchase. While Apple has filed a motion to intervene on behalf of its developers against similar claims, Google hasn’t said anything yet.
Google has made clear that it thinks the patent system is broken and will be looking for reform. The loss of the Nortel patents may be another catalyst for that effort. But those things take time. Right now, Android continues to look vulnerable and companies like Oracle, which is pursuing a patent infringement case against Google, are not letting up on the patent issue.

well you can't blame the others.. Google made an OS filled with technolgy from others... they aren't patent trolling.. this is patent protecton.. Google should spend more money on R&D cause now Android will make more money for others then for Google

No I don't blame MS and Apple.

I just don't understand why Google, with all their brain power and resources didn't see this coming?

Hell yeah.. Google don't tend to invent stuff and patent them.. they buy patents when they need them.. sure you could say they overestimated the patent aquisition but the thing is with android.. while android itself is free.. it's open sourced... you can mess with it.. BUT some of the tech in it requires a license when you use it and if manufactures want to use it in their phones THEY have to pay up the licence fee... that's why nobody is actually gonna go after google.. so yeah google saw this coming and let the manufactures deal with it.. it could get messy if a dozen of companies are going to want make licensing deals for the use of android.. it would just become too expensive..

in the end MS will earn more money then google on android just because they own more patents..

This is pathetic. Apple just won a lawsuit against htc today. However its still there only choice and cheaper than using windows.

Google is a software company. Not a hardware company. They are now in hardware manufacturer's courts, and they have no idea what they are doing, essentially. Furthermore, I don't believe Google wants to invest the kinds of money needed to make Android the undisputed #1 OS....Which is their only achilles heel. They could easily destroy everyone else *if* they wanted to put the resources into it. But unlike few other companies, they have their hands in pretty much everything, and that allows them to easily be picked off by others.



Back from the dead, I'm afraid.

Yea, with Apple winning a patent infringing suit against HTC (Apple already sued Samsung so they might be next) and OEM's paying Microsoft royalty fees for the use of Android, I can really forsee this being the beginning of the end for Android. While I do not believe they will ever dissapear, their market share will surely drop within the next year or two.



Microsoft in particular seems to be in the enviable position of "heads I win, tails you lose." The result of these lawsuits will be to increase the effective price of Android, driving handset manufacturers into Microsoft's (legally) protective arms.

One of the long-term results might be a geographical schism — nothing usual in the mobile phone market. Since most of the difficulty lies in the US patent system, you might see a manufacturer make Windows phones for the US market for the legal protection and Android phones in other regions for the increased customization and reduced licensing cost. Some developers targeted by Lodsys have withdrawn their apps from US app stores to avoid the legal headache while their software remains available in other regions.

The end result could be that the rest of the world will enjoy more mobile choice and innovation than will be possible in the heavily patented US.

It is pretty ironic that MS has a chance to make more money off of Android then Google does. What patents does MS have that they are entitled to so much money off of every android phone?
