However, games could be patched requiring a later version of the firmware to play. Or, game servers could be patched so that the player requires 3.6.
Thing is, I don't mind homebrew, or piracy (I see that it has its benefits, as well as its pitfulls), but I don't like it when it has a detrimental effect on my online play. I played 3 games of CoD4 the other day, and two of the lobbies were ruined by hackers, I know it's not a great sample, but it ruined the game for me. One of my brothers entered a game the other day, and somebody delevelled him back down to lvl 1.
So, as long as developers can lock people out of playing online through firmware checks on the server, or what-have-you, people can stick at 3.55 keep their homebrew and piracy, and it's the best of both worlds. Hell, there may even be a dual-boot option, one version of the firmware when people want to play online, and another one, for homebrew, etc.
