Do we need a chart to make the whole updated firmware concept easier to understand? Older firmware uses more system RAM. Older games have less system RAM available to run. Newer firmware uses less system RAM. Newer games written to run on newer firmware may use that now unallocated system RAM to run optimally, or in some cases run at all as they won't run with less system RAM.

This is just one of many reasons for updated firmware and the reason why any game requiring updated firmware (whether it's to make use of freed up system RAM, security measures, whatever; it's irrelevant so long as it runs) would have the updater on the game disk. Nobody's liable because an end user can't run new software on an older version of a no longer supported (any previous firmware) version of the OS.

Disagree? Then reference a case that shows how any new software written for Windows or Mac OS for example, must run on any previous version of an operating system with the idea that Microsoft or Apple is legally liable if it doesn't.

Ok, yes, the firmware released hs changed the lanscape of the PS3. But, if someone supports the PS3 better then Sony it should be within your rights as the consumer to switch to them. If someone gives me the ability to play PS2 games, run otherOS, better media capabilities, English patches for Japanese games(ToV is getting one, or so I've heard :)), and even games that are only playable on cfw. Whereas Sony only seems to be taking away features. Who do you think I'll be going to?

Yes, It's nice and all to go yelling at these people calling them cheaters, thieves, and pirates. And cheering as Sony is trys to financially ruin their lives. I hope you have fun on consoles that are tied to one company next gen... I'm just glad you aren't a fan of Operating Systems. Would hate for you to call foul when someone tries to bring an alternative to it...

Your hypothetical makes no sense. The PS3 is a gaming machines(more now then ever). PCs are upgradeable, MS can't tell people to support every operating system they released. And you fully expect for your operating system to become out of date and no longer play PC games. Not so for the PS3, it's sole job should be to play PS3 games. If it can't do that then it fail

You missed the point.

Every game published for the PS3 plays on any PS3 with the most current firmware update.

Every game published for the PS3 will not play on any version of the PS3 firmware for reasons explained (twice). Not only is SCE not liable for newer games not running properly or at all on older, unsupported firmware (games that require firmware updates have the latest firmware update on the disk to install without a network connection), but it's not even possible for certain games that make use of updates made to current firmware (such as more free memory) run at all. That's one of many reasons for the firmware updates.

Before anyone wants to make up some claim that SCE is legally obligated to make any game run on any version of any firmware update released by SCE, they can stop right there as SCE is not, any more than Microsoft is legally obligated to have current versions of any software run on older, unsupported versions of their operating system.

Is anyone else not grasping this very simple concept?

Sony can't prohibite people from creating CFW or using them... but your claim of Or you use Sony newer FW or you won't play the games would be invalid.

If someone is supporting PS3 better than Sony so why don't you ask them to release the updates for you to play your new games... and of course as PSN is a Sony property you also can't ask to use other people support and play there, so ask this better supporter to create an Online Community...

If any hacker have really done that how would Sony prosecute them??? Or why would we discuss the cheaters and hackers in PSN?

You must keep one or other you can't expect Sony to do what is better for you the way you want and if they don't you hack your PS3 and keep complaining about Sony, if you are using CFW you are no longer a Sony Customer.

You do know updated firmware comes on disc to? So if you wanted to keep otherOS support you have to stop playing new games.

Where did graf hack the psn or cheat in games. Is it mentioned in the lawsuit? ( i have not read this one)

as far as  i know he never hacked the psn or pirated games so what are you on about? Again I would apreciate any links of sony sueing anybody that has hacked the psn or pirated games. Not these two who have only hacked their ps3 and showed others how to. i do not know much about graf but from what i understand that is the case. So are you actually on their side? you post seems to say so.

Considering Sony is beating everyone coming at them (and the ones they are going after) recently, I'm staying with them.

BTW, Sony was obvioulsy right to disable Linux, because that way they successfully kept PS3 from being hacked, and the Slims that never had Linux in the first place are also completely unhackable. Just thought I should mentions this, because you have to give credit where credit is due!

Not actually the case.  See

They will sue anyone they seem fit don't worry... and liability is from the perceive damage, if divulging system fragility can result in hacking or pirating them they can be sued...

If you teach how to hack a bank security system even if indirectly and the bank get robbed by methods linked to the one exposed them I'm sure the bank will sue the teacher even tough he never robbed a bank or said he were teaching that... when you say something you are somewhat responsible for the use people will do of it.
