Forums - Sony - Sony Suing Geohot and others over PS3 Hacking

Nice try, but too late Sony. the cat is well and truly out of the bag now.

I think some of these hackers were a little brazen to post all those private keys publically on the internet.  I could see a decent lawsuit being made out of this.

Most anticipated games of 2011:

Uncharted 3,Legend of Zelda: Skyward Sword, Rocksmith

Modern Warfare 3, Super Mario 3D

I am perfectly aware you can have some fun applications with this..however within the last few days we have seen several games already being pirated and played thanks to this hacker/s. Heck I saw a video of a ps3 playing Donkey Kong, this is in no way good for the industry, especially in these horrible economic conditions WW.

The problem you have is that you're calling for a man to be held legally responsible for the crimes of others.  It is akin to saying that a markmanship instructor should be held liable if any of his students becomes a murderer.  That does not fly.  Not morally, and certainly not legally.

the analogy you provided was overly simplistic and as you said imperfect. Let me use the same line of thought and give you the opposite end of the outcome. A guy distributes weapons, which he made without permission, to the masses. You can definitely use it to defend yourself, shoot a fly and enter the guinness and be famous BUT this will lead to more harm than good. As yours this is by no means perfect. But like I said for a few neat tricks I won't support piracy, doesn't matter which console it is.

You're actually providing a better analogy, for my purposes, than I did.  The gun distributor in question would not be held liable.  In fact, gun manufacturers are NOT held liable for crimes committed with their products.

IF IT IS DISTRIBUTED ILLEGALLY THEN OF COURSE HE IS LIABLE!

Are you retarded?

Illegally distributed code, ie. the security keys, sounds like grounds for a case. Regardless, there's no point in declaring any of the charges are invalid, even if one was an attorney (which most arguing the case here aren't), as it's up to the courts handling the case to decide.

At this point though, the genie has already been let out of the bottle and while I won't discount future updates that prevent the average user from taking advantage of the current security leak, consoles that are closed off from PSN won't be effected.

In general I do not support piracy, but I also adamantly believe that if I purchase a piece of electronics I have the right to do with it as I see fit.  I'm on team Geohot for this one...

SONY should win the court case.

 1) Reverse engineering software without permission is illegal.
 2) He is using a number of patents in his custom firmware without permission. Remember all those codec's, the ability to play PS1/PS3/PSN games etc, are all patented -- thus distributing this technology without the patent holders permission is illegal.
 3) Piracy is illegal and GeoHot has been trying to pirate games for a while (yes even before other OS was removed)

I doubt that Sony would do anything other than encourage additional hacking of their system by doing this. If sueing was so effective then why didn't Apple sue Geohot? It isn't like they've shown much restraint in the past.

cause they lost the lawsuit for jailbreaking in general.. the court founded jailbreaking legal http://www.eff.org/press/archives/2010/07/26 ... so hacking your PS3 will probably not be illegal so the only thing to get Geohot on is releasing the keys... which probably is just a math sum and I don't think you can claim that.. I can't blaim sony for not trying to get money somewhere from someone..

Face the future.. Gamecenter ID: nikkom_nl (oh no he didn't!!)

good stuff sony hope you win.

yeah buy geohot did alot of illegal things in getting their homebrew to work things that were copyrighted.

If this guy was "smart" he would have sold his technique to the chinese and become a multimillionaire over night.  Instead he gave it away free and will probably be broke the rest of his life.  No matter if he wins or not, he will have to spend whatever money he has on lawyers and Sony can and will drag this out as long as they possibly can just to make this poor bastard pay.  Even though they know they will probably lose this case.  "Apple has already went down this road and lost".

I really don't understand a lot of these posts in here about the guy doing this all for Pirating.  He has stated over and over that the onlything he wanted to do was have homebrew on the PS3.  Sony took out Linux and they should have known that was a big mistake.  Where there is a will there is a way and I think that has been proven now. So instead of just having linux and homebrew, they have that and the ability for millions to pirate games.

While I do not pirate games, I will probably end up "hacking" my console to add a truly epic media center (Like the old XBMC on the original xbox).  The original xbmc was awesome, and I dare say that the one that eventually comes out for the ps3 will be awe inspiring.  I am also guessing that there will be a better browser coming as well.  Only time will tell what kind of awesome sauce is made.  And I can't wait.
