IF IT IS DISTRIBUTED ILLEGALLY THEN OF COURSE HE IS LIABLE!

Are you retarded?

I advise learning what terms mean before you throw them around, buddy.

First off, if this was "illegal" it wouldn't be Sony suing, but the government, since prosecutions are handled by the state and not by individuals.

Second, and more germane to our discussion here, it's far from clear that this distribution is wrongful to begin with.  In the most on-point case so far, jailbreaking one's property has been held to be a legitimate use of hardware by both the regulating federal agency and a court of law, even when that process permitted users to pirate software and break the hardware maker's monopoly over that platform.

In conclusion, learn what you're talking about before accusing others of being mentally challenged.

*sigh*

Tell you what.  If you want to continue to opine on a legal matter despite clearly having no idea what you're talking about, so be it.  If you want to keep grabbing ankles for some faceless multinational corporation that doesn't give a shit about you, you have my permission.  And if you insist on automatically treating people like they're criminals, I don't much care.  You're just not worth my time.

I was refering to gaming.

Still the same. There are dozens of illegal SNES cartridges everywhere. Even without the internet, which actually benefits police in finding people who make illegal copies and sells them, people would just make copies of the games and sell them at flea-markets like the old days.

snes? i mean know and back then it was different those illegal catridges were actually being sold werent they. anyway in this time period no one would pirate nearly as much if the internet was gone. I mean the hackers do it for free because of the luxary of the internet without that they would need to charge people for deliveries and such which wouldnt be wirth the effort. how exactly would they get it to all those people without the net?

SD cards with DS titles on them, DVD-DLs with 360 titles, Blu-rays with PS3 titles, etc. All at flea-markets. Do you really need to ask how a blackmarket for these sorts of things would get to a wide number of people? seriously heroin gets to tons of people on the black market doesn't it? So what would be the difference for any soft of media that people want copies of without paying the insane prices of retail?

lol heroin its different its a street product period no one is really selling it online to begin with. but okay so what your saying is that people will pay to buy these things at flea markets....which are in a huge decline. well firstly they would have to play the people at the flea market to mod their systems and then pay them for the software lol sounds like their buying games to me. sure its cheaper but with the internet you could do that stuff your self or learn to. Also those retail prices arent insane people are just cheap. but yea okay lol.

You realize we are talking about a theoretical world without the internet right? Flea-markets have only declined because of the internet so without the internet they would still be widely successfully and probably a much bigger market place.

Prices would be reasonable like the cartridges were. 360 and Wii titles would be like $5 - $10, DS and PSP $10 - $15, and PS3 $20 - $25. Modding the systems $15 - $25.

Still, you have to remember that consoles would be completely different then they are now. There would be no PSN or XBL.

Does Sony have anything to gain from this lawsuit?

If they win, they will come of as the big greedy empire and will probably be disliked in the public eye. The G4 interview with Gehotz makes him look quite favorably to the public already.

If they lose, they will be rediculed for losing a lawsuit they started to a kid hacker

Worst of all, neither outcome stops PS3 piracy. I mean, the hack is out, sounds like there is no going back...pretty much every PS3 games is playable off the hard drive and about 15 games have been hacked to run online on PSN as backups on the custom firmware...more are added every day.

They really should be focusing on stopping the bleeding on PSN and blocking access for people who are playing with backups, in my opinion.

If they win, he gets made an example of. Exactly what needs to be done.

I assume they are doing something. Their lawyers being busy doesn't mean much since they are obviously not in charge of the coding (though maybe they are looking for new staff in the encyption department XD).

Otherwise, obviously what's out is out, and what isn't, is just going to be released anonymously if they win. As far as the PS3 is concerned the case isn't going to fix anything. But it is going to set a precident, so pretty important nevertheless.

Please explain this to me with valid reasoning...

They win, he gets made example of... Then what? Hacking stops?

Precedent for future lawsuits, mostly.

The efficacy of that is a different question.

When the dust clears on this I think you'll be proved right that it's a lose lose scenario for Sony.  They really must be mad giving a hack in it's infacy so much free publicity before they have even started to plug the gaping holes in their system.
