My guess is that this is similar to the Epilepsy warning for video games, it's a possuiblity they need to legally protect themselves against though the chances are probably not high.

This. There's no scientific evidence for an effect because no real study has been done... yet.

3DS looking good, but I don't know if I want one right now. 3D is very lame and all it does is hurt your eyes.

After having a total of 2 hours of play time at E3 I can verify that at least for me it added a fantastic sense of depth which helped gameplay and I never once had a headache or eye fatigue.
