Well, she won $35,000 for having the prom cancelled due to her attempts to attend with her girlfriend. Her ACLU lawyers successfully argued that the unofficial prom held by district parents in lieu of the official one was a "Sham Prom," so the district settled for $35k, which she will put towards her college education.

While I support her position (they shouldn't have cancelled it), it in no way did personal damage to her of $35k. I really hate when courts award large monetary damages for this sort of thing; it encourages frivolous lawsuits and a culture of suing on the off-chance you get thousands of dollars out of it.

An apology and maybe a small fine (paid to the state, not the girl) would be appropriate.

She was made into the center of a national media circus, albeit for a brief time (and she instigated this anyway), but i'll agree that its kind of random. A more fitting reward would have been to force the district to acknowledge such things in the future, rather than a random payout

But wouldn't that rather encourage them to do it again? As many times as they want? turning the apology afterward into a insult, by paying a minor fee to the state, and laughing in the girls face while saying they are sorry?

maybe she didn't get damaged for 35k, but awarding large amounts of money is exactly the kind of punishment that will make them think about their actions before doing it again, BECAUSE that girl gets the money and not some faceless organization.

In my opinion it's not a matter if she deserves it or not, it's about punishing the  offender where it hurts

A slap on the wrist and a small fee?  The equivalent of the government saying "Naughty naughty bigot parents, don't do that again"

Whats to stop them from doing it over and over again if the punishment is lenient?  The money must go to the girl because then these parents are doing exactly what they didn't want to happen.  They're helping this girl out in life when their aim was to hinder her and exclude her, now they are not only forced to include her in their activities they're actively funding her lifestyle.

 

I think she totally deserved the 35k

You make a good point actually. As a method of behavioral modification, the money is more effective than other possibilities, but i would still rather see lasting change (though this could very well lead to it over fears of a new lawsuit, but its not the best way to go about things)
