Read the comment by the FDNY spokesperson

http://www.nypost.com/p/news/local/brooklyn/emt_duo_on_break_let_preg_mom_die_mrj8Jv8kjmS0Z3FNO4DmiL

And in case you don't want to go to link this is what he said......

"All of our members take an oath to assist others in need of emergency medical aid. They have a duty to act when called," said FDNY spokesman Steve Ritea.

So YES he HAD to help.

Did you ignore my post from before where it said that he did not have to help unless he was "on the clock"?

umm did you not read wht the spokesman said? The oath is regardless of on the clock...the asshole was obviously in uniform..the spokesmans comment really wraps up the "on the clock" debate. We have a friend in the family that is a cop, he said that if something happens wether they are on the clock or not they HAVE to help...in the oath, part of the job.

You believe everything that spokespeople say?  So, all the tobacco lobbyists years ago saying smoking tobacco products were not harmful to your health must be right then?

I could probably come up with a dozen or so relative "spokesman" posts for modern day things as well, I'm just too lazy at the moment.  If you believe everything a spokesperson says then, well, sir you are very gullible.

No i'm not, you must have missed my post when I said my friends brother is an EMT and even he said they have to help.

I didn't "miss" it.  I'm sorry, but I think I am going to go by an official document on the NY website over hearsay from your friend's brother.

I cannot debate what your "friends brother" said as I do not know if it is true or not, I posted gave a link to an official document from the NY State Department of Health website.  Perhaps your friends brother should contact his employers, as according to you, he knows more about the laws of NY than the people who make the rules.

Maybe the laws vary from state to state.

As I said in an earlier post in this thread, I suspect that they do.  In fact upon searching further I have found some links that suggest that EMT's in some states are required to assist weather on or off the clock.  However, this story was about the state of NY.

:)

EDIT: Look at Arizona's law that lets police ask for ID from anyone they think is an illegal for example.  Laws do vary from state to state, and as pointed out by someone else in this thread there should be the same laws that apply over the whole of the USA... I know they do have federal laws, but there is just a lot of stupid stuff that is legal somewhere and illegal somewhere else :P

I'll just say this one more time to conclude what I'm saying.

That women died. Sucks for her and her child. I don't enjoy death.

This man /could/ have saved her. If he did, that's all fine and dandy! But he was in no way shape or form required to save her UNLESS he was on the clock. Regardless of some "oath" he took, he isn't REQUIRED to help unless he is being paid or rewarded in another way.

I'm trying to be as realistic as possible here.

What he did was wrong as an EMT and as a human being, but still nothing justify his death. I hope the criminal gets caught and pay for it.

I agree with it being wrong for a paid EMT to not do his job, but why is it wrong of him as a human being? Nowhere is it written that we must protect each other. That's something we chose to do. There is no law declaring that I must save someone.

Also, kinda going off topic, this was discussed on the radio I listen to awhile ago, if you WERE trained in first aid and you saw someone on the street unconscious and NOT breathing, and you knew CPR would you give them mouth to mouth if you saw they had sores around their mouth (read:herpes)

I wouldn't.

And you can call me insensitive or whatever :P

I carry one of these in my wallet.

Minus the red case

actually maintaining the cardiac massage is more effective than stoping for mouth to mouth... and even if there are 2 of you, you can't do both at the same time anyways.

OoOoOoOoOoOoOoOoOoOoOoOoOoOoOoOoOoOoOoOoOoOoOoO

I'm a nurse and I'd love for some of you guys to need my care. Maybe you wouldn't like it if I looked at you right in the eyes, as you writhed in agony, and my lips formed the words... "Sorry, I'm on lunch break."
