Heavy Rain deserves it over GOW III, having not played either though my opinion isn't worth much, just going by what both games offer in terms of innovation ..

The fact GOW3 did  not receive bad score is  one of the reason it's a contender. It's an amazing experience that a great game to a whole new level. It's just so well done and so beautiful.

Heavy rain will get some mentions but GOW3 is simply a better game.

  • SMG2
  • Zelda
  • Halo: Reach
  • Mass Effect 2
  • Fable III
  • Deadly Premonition(From Destructoid )

My personal would be Tropico 3 so far

why wouldn't smg2 a sequel to a critically aclaimed game be considered?

Too early in the year to be speculating. All of the games listed are bound to, at least, be very good but very good isn't enough to get you game of the year.

For anything not yet released, most impressions are simply based on graphics and perhaps a few hands-on write ups from gaming websites which generally aren't enough to judge between very good games and great games. So by all means speculate which very good games will be released this year but I don't think we have the ability to differentiate the small differences in quality in these games at this time.

My two cents.

Actually the only count I've seen has Bioshock winning by a hair.

I think Mario Galaxy 2 and Metroid: Other M should be under the "not released but likely to be contenders". Seeing as how Mario Galaxy was a GotY contender in 2007, I'm sure #2 will be this year. And just believe Metroid will be contending too.
