Activision (especially Bobby Kotick) deserves to get screwed up by Infinity Ward.



Their victory could help Zampella and West too, as if it will be proven that Activision infringed the contract first they could be considered free from their obligations towards it. If on top of this it will be proven also a form of mobbing by Activision, then troubles for it will get even worse.

As such though, i'm waiting to hear both sides of the story.  Afterall Activisions countersuit claims that West and Zampella actions actually stopped Activision from paying bonuses... these very well may be said bonuses.

It'll all come out in court. All the messy details. Since it's class-action and the stakes are huge, Infinity Ward staff should be able to mount a good case against Activisions no doubt considerable legal team.

And by the time it's settled, we'll be discussing the sales of Respawn's latest game, Medal of Duty 4. It'll be a huge success after Respawn makes the daring decision to set it in World War II.

Should be interesting... I did look up the countersuit.  Activision has some interesting things to say about it/

  • West and Zampella's self-interest in executing their "spin out" plan clouded their judgment to such a degree that they actually attempted to damage the very IW employees they purported to lead. In July 2009, West and Zampella were asked by Activision to provide the names of the IW employees that should receive RSU (restricted stock unit) grants in connection with the Wii SKU. West and Zampella refused. In fact, they suggested Activision should give the grant to the two of them rather than to the IW team. Again, in October 2009, when Activision decided to include IW in its annual equity grant, West and Zampella refused to provide Activision with a list of the names of the IW employees that should receive the grant. In responding to the President and CEO of Activision Publishing concerning the equity grant, West wrote, "You can give all the options to Vince and I, or you can wait like we have asked numerous times."

Since it says wrote... No doubt they have the piece of paper  or email where they said that.

It's sad really.  From all aperances it would seem that so many IW staff are leaving to work with the people who were trying to take all their bonuses.



Irrespective of right vs wrong - they way in which Activision has handled this matter is poor to say the least. You would think that they would be keen to reward the hand that feeds them and not use it as some dangling carrot bribe that forces them to stay in an unhappy environment. I think they deserve far bigger royalties than what they're asking for.

Bizzard is a separtate company from activision entirly.
