I really enjoy having Linux on my PS3. I currently do not have internet at home so I don't have to worry about getting this update right now, but I can say illegal or not, I will use hacked firmware until Sony re-adds Linux support.

Yeah... Piracy didn't kill the PSP software buisness. It saved the PSP hardware buisness outside of Japan.

Im sorry but the law dont back this up. If you dont upgrade your PS3 youll keep "other OS". The update is not mandatory, they dont force you in updating. Actually they simply dont have (legally speaking) to ever update the console if they dont want too.
That being said, morally speaking, its fucked up that a company advertise a service and highly encourage people to subscribe to it. And then decide that to keep using the service you subscribe to, you have to accept they are going to remove a feature from the product you purchase. I dont aknowledge this, but unfortunately theres nothing, legally speaking to do about this. You personally select to have "other OS" remove from your console when updating.

The first time you run into a PS3 game that you cannot play on your PS3, Sony's product doesn't correspond to the description it was sold to you under, and at least under EU law you have a pretty firm footing.

I know some games might get you to update, but those update will not remove "otherOS" for legal reason, its obvious. The update will be needed only to connect to PSN. Its the only service agreement they can use legally speaking to remove "otherOS".
That is not apparent with their wording:
"Playback of PS3 software titles or Blu-ray Disc videos that require PS3 system software version 3.21 or later."
Sony never said that. Some people talking about this, journalist, reporter, blogger simply assumed that. Some newest game ask for an update if yours is very outdated, thats true, but those update will not remove "other OS". Having a mandatory update to play game that would remove "otherOS" would go against law of many country. While if its only banning PSN, its all legal. If you try to find an article (I did), where Sony claim anything like your sentence, make sure its between "quotes". Journalist tends to exagerate things, like saying it wouldnt let you play newest games and bluray.
